Terms of Service for AI Image Changer

Plain-language policies for a product that processes personal images and creative work.

1. Acceptance of These Terms

These Terms of Service ("Terms") govern your access to and use of aiimagechanger.org, including its AI image-editing tools, accounts, credits, subscriptions, and related services (collectively, the "Service"). The Service is provided by AI Image Changer ("AI Image Changer," "we," "us," or "our").

By accessing or using the Service, creating an account, or purchasing credits, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use of the Service.

You may not use the Service if applicable law prohibits you from doing so. If you use the Service for a company or another organization, you represent that you have authority to bind that organization, and "you" includes that organization.

3. The Service

AI Image Changer lets users upload images, provide natural-language instructions, select supported AI models, and generate or edit images. Features, model availability, generation speed, credit cost, output resolution, and usage limits may change as the Service evolves.

AI systems are probabilistic. Results may be inaccurate, unexpected, offensive, similar to other outputs, or unsuitable for your intended use. We do not guarantee that an output will match your prompt, be unique, be error-free, or qualify for intellectual-property protection.

You are responsible for reviewing every output before publishing, distributing, selling, or relying on it.

4. Accounts and Security

Some features require an account. You agree to:

  • Provide accurate and current information;
  • Maintain only accounts you are authorized to use;
  • Keep passwords and authentication credentials confidential;
  • Promptly notify us of suspected unauthorized access; and
  • Accept responsibility for activity performed through your account, except to the extent caused by our breach of applicable obligations.

We may reject, reclaim, or require changes to account names that impersonate others, violate rights, or create security or legal risk.

5. User Content

"User Content" means images, prompts, instructions, text, and other material you submit to the Service.

You retain any rights you hold in your User Content. You grant us a worldwide, non-exclusive, limited license to host, copy, transmit, modify as technically necessary, and process User Content solely to operate, secure, support, and improve the Service, fulfill your requests, and comply with law. This license lasts only as long as reasonably necessary for those purposes, subject to backup, legal, and record-retention requirements.

You represent and warrant that:

  • You own your User Content or have all permissions necessary to upload and process it;
  • Your use of the Service and User Content does not violate copyright, trademark, privacy, publicity, contractual, or other rights;
  • You have valid consent from identifiable people where required, especially for face, body, clothing, or identity-related edits; and
  • Your User Content and instructions comply with these Terms and applicable law.

Do not upload confidential information, trade secrets, regulated data, or sensitive personal information unless you are legally authorized and accept the risks described in our Privacy Policy.

6. AI Outputs

As between you and AI Image Changer, and to the extent permitted by applicable law, we do not claim ownership of the images generated specifically for you through the Service ("Outputs"). You may use Outputs subject to these Terms, applicable law, and any restrictions imposed by the selected model or third-party provider.

You understand that:

  • Laws may not recognize copyright or other exclusive rights in AI-generated material;
  • The same or similar Output may be generated for another user;
  • An Output may resemble existing people, brands, characters, styles, or copyrighted works;
  • We do not conduct intellectual-property, publicity-rights, or legal clearance for Outputs; and
  • You are solely responsible for determining whether and how an Output may be used.

No Output constitutes professional, legal, medical, financial, or other expert advice.

7. Acceptable Use

You may not use the Service to create, upload, request, distribute, or facilitate content or conduct that:

  • Is illegal, fraudulent, deceptive, defamatory, harassing, threatening, or discriminatory;
  • Exploits or sexualizes minors, depicts child sexual abuse material, or endangers a child;
  • Creates or distributes non-consensual intimate imagery or sexual content involving a real person without explicit consent;
  • Impersonates a person, fabricates evidence, or uses deceptive deepfakes in a way likely to cause harm, fraud, or public confusion;
  • Violates copyright, trademark, privacy, publicity, biometric, or other rights;
  • Enables identity theft, unauthorized surveillance, facial recognition, or biometric identification of a person without a lawful basis and required consent;
  • Promotes violence, terrorism, self-harm, or instructions to commit wrongdoing;
  • Contains malware, attempts to gain unauthorized access, probes vulnerabilities, or interferes with the Service;
  • Circumvents rate limits, credit systems, access controls, or safety measures;
  • Uses automated means to scrape or access the Service except through an interface or API we expressly authorize;
  • Resells, sublicenses, or provides shared access to the Service without our written permission; or
  • Places an unreasonable load on the Service or uses it to compete through unauthorized copying or reverse engineering.

We may remove content, block a request, suspend access, preserve relevant records, or report conduct where reasonably necessary to enforce these rules, protect people, or comply with law.

8. Credits, Pricing, and Payments

Certain generations require credits. The applicable credit cost is shown in the Service and may vary by model, resolution, or feature.

  • Credits are a limited, revocable license to use paid Service features. They are not money, stored value, or cryptocurrency and have no cash value.
  • Credits are personal to your account and may not be transferred, sold, or exchanged unless we expressly allow it.
  • Promotional or free credits may expire or be subject to additional limits.
  • Purchased credits may expire as disclosed at checkout or in the applicable plan. Mandatory consumer rights remain unaffected.
  • You authorize the payment provider to charge the amount, currency, tax, and billing interval shown at checkout.
  • If a subscription is offered, it renews automatically at the displayed interval until canceled. Cancellation takes effect according to the terms shown at checkout or in account billing settings.
  • Prices, included credits, and future renewal prices may change. We will provide notice where required by law.

Except where required by law or expressly stated at checkout, completed credit purchases and consumed credits are non-refundable. If a generation fails because of a verified Service error, we may restore the relevant credits at our discretion or as required by law. You are responsible for applicable taxes except taxes imposed on our net income.

9. Third-Party Services and Models

The Service relies on third parties, including Kie.ai and its supported AI models, cloud infrastructure, storage, authentication, email, analytics, and payment providers. Your request may be transmitted to and processed by those providers.

Third-party services may have their own terms, content restrictions, privacy practices, availability, and retention policies. We are not responsible for a third party's independent acts or omissions. A provider may change or discontinue a model, which may require us to modify or remove a feature without advance notice.

10. Intellectual Property and Feedback

The Service, excluding User Content and Outputs, including its software, interface, design, branding, documentation, and underlying technology, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms do not grant you ownership of the Service or the right to use our names, logos, or branding.

If you voluntarily provide feedback, suggestions, or ideas, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use them without restriction or compensation, provided we do not publicly identify you without permission.

If you believe content processed or made available through the Service infringes your copyright, trademark, privacy, publicity, or other rights, email support@aiimagechanger.org with:

  • Your contact information;
  • Identification of the protected work, person, or right;
  • The specific content or URL at issue;
  • A statement explaining why the use is unauthorized; and
  • A statement that the information provided is accurate and that you are authorized to submit the complaint.

We may request additional information, remove or restrict content, and suspend repeat infringers where appropriate.

12. Privacy

Our Privacy Policy explains how we collect and process information, including uploaded images, prompts, account details, and generation records. By using the Service, you acknowledge those practices.

13. Service Changes and Availability

We may add, modify, limit, suspend, or discontinue any part of the Service. We do not promise uninterrupted availability, permanent storage of User Content or Outputs, or continued access to a specific model.

You should download and back up Outputs you wish to keep. We are not a permanent archival or backup service.

14. Suspension and Termination

You may stop using the Service at any time. You may request account deletion by contacting support or by using an account-deletion feature if available.

We may suspend or terminate access, restrict generations, or remove content if we reasonably believe that you violated these Terms, created risk or legal exposure, failed to pay amounts due, abused the Service, or if suspension is necessary to protect the Service or others. Where appropriate and legally required, we will provide notice and an opportunity to appeal.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive will survive, including provisions concerning payments, intellectual property, disclaimers, liability, indemnification, and disputes.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available." We disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and satisfactory quality.

We do not warrant that the Service or any Output will be uninterrupted, secure, error-free, lawful for your intended use, or free of third-party claims. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by law, AI Image Changer and its affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, business opportunities, or the cost of substitute services, arising from or related to the Service.

To the maximum extent permitted by law, our total liability for all claims arising from or related to the Service will not exceed the greater of: (a) the amount you paid to us for the Service during the 12 months before the event giving rise to the claim; or (b) USD $100.

These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose. They do not apply where liability cannot be limited under applicable law, including certain liabilities for fraud, willful misconduct, death, or personal injury.

17. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless AI Image Changer and its affiliates, personnel, licensors, and service providers from claims, liabilities, damages, losses, and reasonable expenses arising from your User Content, your Outputs or use of them, your violation of these Terms, or your violation of another person's rights or applicable law.

This section does not apply to the extent a claim results from our own breach, negligence, or unlawful conduct, or where indemnification is restricted by applicable consumer law.

18. Disputes and Applicable Law

Please contact support@aiimagechanger.org first so we can try to resolve a concern informally.

These Terms are governed by the laws applicable in the jurisdiction where the operator of AI Image Changer is established, without regard to conflict-of-law principles. Courts with lawful jurisdiction over the operator and the dispute may hear claims. If you are a consumer, this section does not deprive you of mandatory protections or the right to bring a claim in any forum available under the laws of your country or region.

19. Changes to These Terms

We may update these Terms to reflect changes to the Service, providers, pricing, or law. The updated Terms will be posted on this page with a revised date. If a change is material, we will provide additional notice where required. Your continued use after the effective date of updated Terms means you accept them; if you do not agree, stop using the Service.

20. General Terms

These Terms and the Privacy Policy form the agreement between you and us regarding the Service. If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them as part of a merger, reorganization, sale, or transfer of the Service, subject to applicable law.
